Through the website, BLANC ROXOR CATERING SRL (hereinafter referred to as YVY CATERING) with the address in Constanta Municipality, Str. TURDA, No. 8, LOT 2, C4, Constanta County, offers services regarding the placement of orders and the delivery of products from the menu displayed on the website in accordance with the available delivery areas (Constanta municipality and neighboring localities).

1. Order information

You can place orders through our website during business hours, Monday to Sunday, between the hours of: 09:00 – 18:00

To benefit from the products on the site, it is necessary to place a minimum order worth 50 lei for deliveries within the municipality of Constanta.

For orders with delivery in the localities adjacent to Constanta, please consult the list of delivery areas available on the website yvycatering.ro.

After placing an order through the website, we will send you an email confirming that your order has been received and accepted.

Please ensure that you have provided us with a correct phone number and email address, as this is how we will communicate with you regarding your order, and check the spam section of your email service if you do not receive the confirmation email.

Please also ensure that you have provided a correct and complete delivery address to ensure that the ordered products arrive at the correct location.

If you do not open the door or cannot be contacted by phone upon the arrival of the delivery personnel at your address, the delivery personnel reserves the right to leave the premises, and YVY CATERING reserves the right to recover from you any damages that YVY CATERING may suffer.

To place an order, you may be expressly asked to agree to the Terms and Conditions of Use and the Privacy and Personal Data Protection Policy. By continuing to use the services, you confirm that you agree to these Terms and Conditions of Use (“Express Consent”). YVY CATERING may retain your express consent as evidence of your agreement. Although only some of the services may require express consent, you should not use any of the services unless you agree to the Terms and Conditions of Use and the Privacy and Personal Data Protection Policy.

2. Products

The products offered through the site may vary depending on availability. We undertake to deliver the products from the menu displayed on the site within the limits of their availability.

The daily menu will be delivered within the available quantity, from Monday to Friday, between 09:00 and 14:00.

Please note that YVY CATERING will make every effort to ensure the availability of the products displayed on the site at all times and also to respect the delivery time communicated to you upon order confirmation; however, delivery times may be affected by factors beyond its control and therefore cannot be guaranteed. We will do our best to inform you if we become aware of an unexpected delay in the delivery of your orders to you.

It is your responsibility to inform us at the time of placing your order if you suffer from an allergy. YVY CATERING cannot guarantee that the products sold are allergen-free.

3. Incentives.

YVY CATERING poate oferi credite în scopul achizițiilor viitoare, discount-uri la comenzi și produse gratuite (în general „Stimulente”) pentru comenzile pe care le plasați online. Fiecare Stimulent poate avea o dată de expirare și reguli specifice care stabilesc dacă Stimulentul poate fi solicitat spre utilizare la o comandă conform „Regulilor privind Stimulentele” aplicabile fiecărei campanii promoționale pe care o vom derula. În cazul în care, pentru un Stimulent acordat nu este specificată o dată de expirare, YVY CATERING își rezervă dreptul de a retrage oricând oferta, la libera lor alegere.

Some Incentives can only be used once per user. If you have used a single-use incentive for an order and that order is cancelled for any reason, you will have the right to claim that incentive for use on another order provided that the Incentive Rules and expiration date are complied with and without any limitation on YVY CATERING's rights to refuse the Incentive.

Any credits you receive for future orders as a result of using an Incentive will have their own redemption rules and expiration date. Unless otherwise stated, all credits will expire within 3 months of being credited to your account.

4. Order cancellation

You understand that your order will be processed as soon as it has been confirmed and, as such, your right to cancel or modify the order is limited.

If you wish to cancel or modify an order you must contact us immediately. Our ability to comply with your requests will depend on the time at which you contact us.

While we will make every effort to ensure that the prices and product descriptions displayed on the Site are respected, we reserve the right to cancel any order that is based on inaccurate information. An order may be cancelled even after it has been confirmed. We reserve the right to cancel any order, before or after confirmation, and we will notify you immediately of any such cancellation. You will not be charged for orders cancelled in accordance with this clause. Any payment made prior to us cancelling an order will be refunded to you, usually using the same method you used to pay for your order.

You do not have the right to withdraw your order placed online on the site if and when it concerns the delivery of goods, which: (a) are subject to deterioration or expire quickly, or (b) are made to the consumer's specifications or personalized. The products sold by us fall into both categories.

5. Price. Refund Policy

The price of the products will be indicated on our website. Prices include VAT. Prices may change at any time, but changes will not affect confirmed orders, except in the case of an obvious price error, in which case we will notify you as soon as possible of this issue. You have the right to cancel your order as soon as we notify you of any price change.

Payment for all Products can be made:
– in cash to the person delivering the order, upon delivery of the products
– online payment; the order is paid by bank card through the payment processor PlatiOnline.eu. If you have chosen the payment method using a bank card, you will need to fill out a form with your card information on a secure page. In this case, when placing your order, your credit or debit card will be authorized and the amount marked for payment. Your bank statement will show a payment made to YVYCATERING.

If your order is cancelled or modified, your credit card authorization may be reversed. Please note that your bank may not recognize reversed amounts originating from our payment processor. As a result, the original authorization may remain in your bank account until it expires.

This can take between 1 and 4 weeks depending on your bank. If you want to clear this authorization sooner, you must contact your bank to ask them to cancel the transaction.

All sales are final due to the nature of the products not being suitable for resale. If you do not receive your order or if an item is missing from your order you must contact us.

6. Delivery information

The standard delivery time is 60 minutes and will be communicated by phone at the time of order confirmation. The approximate delivery time for telephone orders is that communicated by the telephone operator, and for online orders it will be communicated at the time of order confirmation, this may be influenced by traffic conditions and/or the number of orders in progress at the time of order pickup.

All orders will be delivered to the address you provided when placing the order, by a courier, company employee or a third party with whom we have concluded a delivery service contract.

Delivery costs are:

• 20 lei for orders under 50 lei in Constanta
• 35 lei for orders under 85 lei in adjacent areas (Mamaia Nord, Lumina, Năvodari, Ovidiu, Cumpăna, Agigea, Eforie and Techirghiol)

At the time of delivery of the order/products, you must ensure the delivery person's access to the address (in the yard or building) and answer the phone number mentioned when placing the order, in cases where the delivery person is unable to find the exact address or gain access to the building.

In the event of failure to accept delivery of the order within the communicated delivery time or if the delivery person fails to deliver the order due to inadequate instructions sent by you or lack of response to the delivery person's calls, these orders will be considered to be delivered to you, all risks and responsibilities in such situations being transferred to you.

www.YvyCatering.ro provides information about delivery areas, as well as areas where minimum orders are required.

The map and zoning is designed for informational purposes only and does not create our obligation to deliver to a specific address within an area.

Please check the website before placing your order to see if you are in these areas.

If you would like to specify certain aspects regarding delivery such as: delivery time, address or landmarks, please enter these aspects in the comments section before completing the order.

7. Pricing errors

We make every effort to ensure that the prices indicated on the website www.YvyCatering.ro are correct. However, errors may occur. If we identify an error related to the price of a product/s already ordered by you, you will be informed as soon as possible about the error. In these situations, you will have the option to either reconfirm the order at the correct price or cancel the order.

If we are unable to contact you within a reasonable time using the contact details you provided during the ordering process, we will consider the order cancelled and you will be notified of this by email.

If you choose to cancel your order, after being informed of the correct prices of the products, but prior to this moment you have already paid the price of the ordered products, we will fully refund you the amount paid as soon as possible (but no more than fourteen (14) calendar days from cancellation).

If the product has already been delivered, the correct price of the product is the one listed on the invoice, meaning the customer can pay the difference or refuse the order.

To the extent that we have not informed you of the error that occurred regarding the prices of the products ordered, according to the provisions of this section, and the order has been confirmed, the products will be delivered according to the confirmed order.

8. Limitation of liability

We try to ensure that the information available on the site is correct and does not contain errors or omissions, and in the event of a malfunction in this regard, we apologize in advance.

We cannot guarantee that the use of the site will be error-free in terms of the purpose for which it was established, but in due course, defects will be corrected. We cannot guarantee the full functionality, accuracy and reliability of the site and we do not provide any warranty, express or implied, in relation to the fulfillment of the purpose or correctness.

We do not assume liability for any delays, errors, omissions or losses of transmitted information, generated by viruses or other destructive programs transmitted to the computer, through our website, by the Client or third parties.

We have taken all reasonable measures to prevent internet fraud and to ensure that all data collected from you is stored securely, and in this regard, we ask you to review the Privacy Policy and Personal Data Protection displayed on our website.

We will not be liable for any delay in performance or failure to provide related products or services if problems arise as a result of any event beyond our control.
